By downloading, installing, or using Happy Munch ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.

2. Description of Service

Happy Munch provides personalized meal recommendations based on menu photos and your dietary goals. The App uses machine learning technology and computer vision to analyze menu images and suggest menu items that align with your specified health and fitness objectives.

3. User Obligations

You agree to:

• Provide accurate information about your dietary goals and restrictions
• Verify all dietary information, especially regarding allergens and restrictions, directly with restaurant staff
• Use the App only for lawful purposes
• Not attempt to reverse engineer or modify the App
• Not use the App to harass, abuse, or harm others
• Respect the intellectual property rights of restaurants and menu creators

5. Technology Accuracy and Limitations

While we use advanced machine learning and computer vision technology to analyze menus and provide recommendations, you acknowledge and agree that:

• Our technology cannot achieve 100% accuracy in menu analysis
• Photo quality, lighting, and menu presentation affect analysis accuracy
• Menu items, ingredients, and preparation methods may vary from descriptions
• Restaurant menus and recipes change frequently without notice
• Hidden ingredients, cross-contamination, and preparation variations may not be detectable
• Translation and interpretation of foreign language menus may contain errors

Users must independently verify all critical dietary information with restaurants.

6. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account.

7. Privacy and Data Use

Your use of Happy Munch is also governed by our Privacy Policy. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.

8. Intellectual Property

All content, features, and functionality of Happy Munch are owned by Cohabby and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of the App without our express written permission.

9. User-Generated Content

By uploading menu photos or other content to the App, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and analyze this content for the purpose of providing our services. You represent that you have the right to upload such content.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• HAPPY MUNCH, COHABBY, AND THEIR AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• THIS INCLUDES, WITHOUT LIMITATION: PERSONAL INJURY, ALLERGIC REACTIONS, ILLNESS, LOSS OF PROFITS, DATA LOSS, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM
• WE SPECIFICALLY DISCLAIM LIABILITY FOR ANY ADVERSE REACTIONS, ALLERGIC RESPONSES, OR HEALTH CONDITIONS RESULTING FROM FOOD CONSUMPTION

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above limitations may not apply to you.

12. Assumption of Risk

By using Happy Munch, you acknowledge and agree that:

• You assume full responsibility for your dietary choices and their consequences
• You understand the inherent risks in relying on technology for dietary decisions
• You will not hold Happy Munch or Cohabby liable for any adverse health effects
• You will independently verify all critical dietary information

13. Indemnification

You agree to indemnify, defend, and hold harmless Cohabby, Happy Munch, and their officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from:

• Your use of and access to the App
• Your violation of any term of these Terms of Service
• Your violation of any third-party right, including without limitation any copyright, property, or privacy right
• Any claim that your use of the App caused damage to a third party
• Any allergic reactions, dietary issues, or health conditions allegedly resulting from your use of our recommendations

14. Termination

We reserve the right to terminate or suspend your account at any time for violations of these Terms or for any other reason at our sole discretion, with or without notice.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms in the App and updating the "Last Updated" date. Your continued use of the App after such changes constitutes acceptance of the new Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in courts located in California.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
